A recent legal opinion has challenged the U.S. Drug Enforcement Administration’s (“DEA”) stance, suggesting that international treaties related to drugs should not hinder cannabis rescheduling as recommended by the U.S. Department of Health and Human Services (“HHS”). According to the opinion, doing so would be more in line with the country’s duties under international legislation to regulate marijuana in a manner that safeguards public safety and health.

Prepared by lawyers from Vicente LLP and Porter Wright LLP firms, the opinion aims to counter the DEA’s assertion in 2016, when it denied a previous request for a cannabis rescheduling. At the time, the agency maintained that cannabis could not be classified under a less stringent schedule than Schedule II because of international drug agreements.

The legal paper contends, however, that these treaties give countries enough latitude to create drug laws that put national welfare and health first, even if doing so means ending prohibition.

The Coalition for Cannabis Scheduling Reform, an advocacy group and association representing various marijuana-related groups and businesses, commissioned the paper, which has been shared among members and in private with key government figures.

While concerns have previously been raised by individuals such as Representative Andy Harris regarding treaty obligations, noting potential violations of the Single Convention of 1961, a group of senators has highlighted revisions to global marijuana scheduling laws, citing countries such as Canada, which have legalized and regulated cannabis without repercussions. The writers point to Canada and Uruguay in support of their reading that international drug treaties broadly support regulating drugs for safety, research and medical applications. Further, they note that the DEA has in the past rescheduled a cannabis-based medication, Epidiolex, after it received FDA approval, showing that there has been precedent for changing the categorization of cannabis.

The opinion not only refutes the notion that drug treaties forbid cannabis reclassification, but it also emphasizes the member nations’ latitude in upholding treaties even when doing so contradicts their internal constitutions.

This becomes especially important in the case of the adult-use cannabis markets that are already operating and have been approved by state legislation. The opinion argues that closing state markets on treaty grounds would violate states’ fundamental constitutional rights and highlights the existence of treaty exceptions when constitutional constraints are in effect. Moreover, the opinion underscores the legal discrepancy between the final rule and final order in DEA rescheduling proceedings, suggesting that treaty obligations could enable the agency to bypass the rulemaking process.

Data from the European Automobile Manufacturers’ Association (ACEA) has revealed that drivers in the European Union registered 92,741 battery electric vehicles (BEVs)  last month. The share of BEVs in Europe increased from 9.5% in January 2023 to 10.9% last January, representing a year-over-year increase of 28.9%.

BEV sales in EFTA nations alone increased from 4,273 units last January to 7,250 units last month (69.7% year-over-year increase). ACEA data also shows that plug-in hybrids and hybrids were popular as well.

Hybrids ranked as the second-most preferred vehicle choice among car buyers in the European Union, with 245,068 registrations in January. Automakers sold 21.4% more hybrids and 24.4% more plug-in hybrids last month compared to January 2023. However, hybrid EV sales in BAFTA nations went down by 4.4% in January 2023 compared to last January while plug-in hybrid sales in the UK increased by 14.7%.

Despite increased consumer interest in BEVs, hybrids and plug-in hybrids, internal combustion engines (ICE) still hold the lion’s share of the vehicle market. Petrol and diesel-powered vehicles accounted for 35.2% and 13.4% of total vehicle sales, followed by hybrids at 28.8%, battery electric vehicles at 10.9% and plug-in hybrids at 7.8%.

As a testament to the EU’s progress in electric vehicle adoption, 8.7% of all the vehicles sold in January had some kind of plug. Most European nations have pledged to incorporate battery electric vehicles into their transportation sectors to help combat climate change.

Transport is currently one of the largest polluters on the planet and accounts for at least one-third of global greenhouse-gas emissions. Replacing internal combustion engines with electric powertrains and eliminating fossil fuel use in vehicular transportation can help cut tailpipe emissions to zero.

Adobe has unveiled an artificial intelligence assistant that can search PDFs, produce summaries and answer questions about a user’s PDF documents. The computer software company launched the AI assistant in its Acrobat applications and reader, and is planning to release a subscription plan for the tool once it is past beta testing.

Unlike other AI models, such as ChatGPT, which need users to upload a PDF document before providing an analysis, the AI assistant from Adobe will be built into its reader and applications. A news release said the AI assistant is currently available on Acrobat and noted that Adobe Reader’s built-in AI assistant would gain additional features over the next days and weeks.

According to Adobe, the artificial intelligence-powered assistant can help Adobe users digest information from lengthy PDF documents by creating brief content overviews. The AI assistant can answer user questions about a PDF document’s information via a “conversational interface” and suggest questions related to the document. Adobe says its new AI assistant can help users create citations that allow users to prove the authenticity of the answers the chatbot provides.

The chatbot can also create clickable links to help users jump directly to certain parts of massive documents and access specific information. It can also generate text for formats such as reports, presentations and emails, the news release said.

Adobe Systems CEO Shantanu Narayen said in a recent interview that the new AI tool represents the software company’s goal of “democratizing access” to the trillions of PDF documents that are currently in use globally.

Described as a conversational engine, the tool can recommend more content based on what users are currently reading. It essentially allows Adobe users to “chat with documents” and learn what they need from long documents that would typically require much more time to summarize.

Adobe’s plan for the chatbox is to minimize the time-consuming tasks involved with working with large documents such as studying for research projects or creating highlights from massive reports to use in presentations, meetings and emails. The AI assistant can summarize and answer questions from all the document formats Adobe Reader supports, including PowerPoint and Word. Once it is launched, the AI assistant can also analyze a document’s content and consolidate it into formatted and digestible copy for reports, and presentations.

The AI assistant is currently available to Standard Adobe customers for $12.99 per month, Pro customers for $19.99 per month, and Teams subscription plans on both web and desktop.

Indonesia is set to surpass its 2023 sales after forecasted shipments for January and February 2024 soared by almost 25% in comparison to the same months in 2023. The country, which is the largest exporter of thermal coal globally, is expected to record more than 90 million metric tons of thermal and thermal bituminous coal sales in the first two months of this year.

Last year, total exports from Indonesia surpassed 504 million tons. This has many expecting that exports this year will go even higher. The top markets for Indonesian coal thus far include China, the Philippines, South Korea, Japan and India. These countries were also major importers of coal in 2023.

With regard to volume, China imported more than 29 million tons in February 2024, representing a 9% drop in total imports recorded over the same period last year.

This may not be complete information though. Based on tracking data, more than 21 million tons of cargo do not show a confirmed final destination on the manifests. Most of these ships are probably heading to China, given the country is the biggest consumer of coal. However, this cannot be confirmed until the current break ends.

India’s coal imports for this month also passed 13 million tons, making this its highest quantity imported since February 2020. In total, India imported almost 101 million tons of Indonesian coal in 2023.  Data also shows that exports to Malaysia, South Korea, Japan and the Philippines dropped in comparison to January and February 2023. However, it is expected that once ship manifests are updated, increases in volumes may be recorded.

One driver of coal demand in the aforementioned countries will be the economy of China rebounding from the plunge recorded in 2022. A persisting debt crisis has stifled the heavy industry and construction sectors in China. In an effort to revive growth, Beijing is planning to announce new measures in March at its next parliamentary meeting.

If the measures are successfully implemented, the use of energy and industrial activity will increase in China as well as other regions of Asia as product and material suppliers up production. Vietnam’s use of coal and industrial activity is also expected to increase if the economic growth of China improves.

The recovery of China’s construction industry is also expected to increase demand for construction parts and materials throughout the supply chain, which pours into Vietnam in form of steel and cement plants.

As the coal exports from Indonesia show, the world may still need coal producers such as Peabody Energy Corporation (NYSE: BTU) for longer than advocates for transitioning away from fossil fuels would wish. Setting up sufficient and reliable renewable energy sources is proving to be harder than initially thought.

Prospera noted in the news release that it has positioned itself in 2023 to execute the second phase of its development plan aimed at increasing production through medium-oil development in Alberta and leveraging horizontal wells to capture the significant remaining reserves in Saskatchewan.

During the company’s investor summit in August 2023, Prospera CEO Samuel David provided more information regarding this three-phase strategy:

Phase I

Prospera completed the first phase of its restructuring by optimizing operations at its existing assets and addressing legacy arrears and non-compliance issues.

At the beginning of this transformation, the company was producing just 80 barrels of oil equivalent (BOE) per day. In Q4 of last year, Prospera peaked at nearly 1,200 BOE per day. Its breakeven is around 500 barrels per day, illustrating the opportunity for free cash flow. This prospect has driven Prospera’s capital development and optimization in recent quarters.

After a temporary slowdown in production due to harsh winter conditions, Prospera is currently producing about 800 BOE per day and anticipates an additional 300-500 barrels of daily production following the completion of ongoing site maintenance work.

This sustained increase has pushed the company’s NPV from roughly $3 million prior to the restructuring efforts to approximately $72 million today.

In an effort to build on this progress and maximize its available resources, Prospera piloted two horizontal reentries to assess a potential horizontal well transformation at its properties.

Phase II

Following up on the optimization efforts of Phase I, Prospera aims to commence a horizontal well transformation at its properties in the coming months. Based on its pilot wells from Phase I, the company has proposed 10 horizontal well locations at its Cuthbert and Heart Hills properties.

Prospera has likewise proposed eight medium light oil direction wells at its Alberta property, and it is exploring strategic acquisitions aimed at expanding its core area and diversifying its product mix.

Other facets of Phase II include piloting an enhanced oil recovery (EOR) application and continuing to execute its liability management goals and ESG initiatives. Prospera has already abandoned 60 vertical wells as part of its three-year LMR plan to reclaim surface land and reduce the environmental footprint of its operations.

Phase III

Beginning next year, Phase III of Prospera’s corporate redevelopment strategy will focus on continuing the company’s horizontal modular development to appreciate production and optimize recovery of remaining reserves. Prospera intends to implement full-scale EOR applications based on the results of its Phase II pilot program, which is forecast to optimize recovery by greater than 10%.

Prospera also intends to continue its acquisition strategy to diversify its product mix. Its goal, as detailed by in August 2023 investor summit, is to attain 50% light oil, 40% heavy oil and 10% gas – all while continuing to eliminate carbon emissions as part of its existing ESG initiatives.

Poised for Growth

Following its transformational efforts in 2022, Prospera is poised to achieve record growth in 2023. The company has forecast significant reductions in production costs through 2024, alongside sizable increases in daily production.

Prospera is currently exploring strategic acquisition targets to potentially increase its production beyond 5,000 BPD while expanding its reserve base to a billion barrels.

Market Opportunity

While the oil and gas industry faces long-term geopolitical and macroeconomic uncertainty, there is a clear trend to secure supply in the short term. According to Deloitte, the global upstream industry ended 2022 with some of the highest free cash flows on record, driving reinvestment in hydrocarbons and overall investment in clean energy.

The Energy Information Administration recently forecast a dip in global oil inventories over each of the next five quarters, placing upward pressure on oil prices. Projects

PCH Project-Brazil

The PCH project hosts REE mineralization in both ionic clays developed from the weathering of alkaline granites and in-situ rare earth mineralization associated with the underlying granite and a carbonatite intrusion to depths greater than 100 meters. Sampling data shows enrichment in rare earth minerals to depths of between eight meters and +30 meters.

In early 2023, Appia announced a definitive agreement to acquire a 70% interest in the PCH Project, which is 17,551 hectares in size and located in the Tocantins Structural Province of the Brasília Fold Belt, Goiás State, Brazil. It is classified as an alkaline intrusive rock occurrence with the potential for highly anomalous REE and Niobium mineralization.

The region around Iporá, a city located roughly 30 km from the PCH Project, has significant mineral exploration and mining activity and well-developed infrastructure.

In July 2023, Appia commenced an aggressive auger and reverse circulation (RC) drill campaign to delineate a potential resource estimate at the PCH project. Initial results at the site revealed significant exploration potential with impressive values that often surpass known ionic clay deposits in Brazil, particularly for the highly valuable heavy rare earths Terbium and Dysprosium.

The auger holes drilled at Target 4 have exhibited a range of total REE grades, ranging from 274 ppm to 16,648 ppm (1.66%), with an average of 1,291 ppm total REE. The valuable rare earths used in magnet applications – praseodymium, neodymium, terbium and dysprosium (Pr, Nd, Tb, and Dy) plus yttrium (Y) accounted for approximately 14% of total rare earths, reaching a maximum of 28.4%. Notably, the deposit also contains anomalous values of niobium and scandium, with average values of 736 ppm for Nb and 62 ppm for scandium in a composite sample from Target 4.

Heavy rare earths (HREEs) show maximum values of 1,624 ppm and average values of 1,291 ppm, primarily as terbium and dysprosium. Light rare earths (LREEs) show maximum values of 14,024 ppm (1.54%) with an average of 1,145 ppm. Neodymium and praseodymium, the main magnetic light rare earths, show respective maximum values of 3,131 ppm (Nd) and 885 ppm (Pr) and average values of 216 ppm (Nd) and 61.7 ppm (Pr). The overall HRRE/LREE ratio has a maximum of 39.5% and an average value of 16.67%.

Alces Lake Project – Saskatchewan

Appia’s Alces Lake project, located in northern Saskatchewan, encompasses some of the highest-grade total and critical REEs and gallium mineralization in the world, hosted within several surface and near-surface monazite occurrences that remain open at depth and along strike.

Following the company’s acquisition of additional new mineral claims in the area in February 2023, Appia’s Alces Lake claim block now totals 38,522 contiguous hectares (95,191 acres) – 100% owned by the Company.

Appia announced the completion of a NI43-101 technical report on the property in June 2023, providing an update on exploration previously reported in March 2021.The report is available on SEDAR under the company’s profile.

Extensive diamond drilling and geophysics surveys are underway to explore a more than 25-kilometer structural corridor. In July 2023, the company issued an update on its diamond drill program having completed the first phase of drilling at the project’s Magnet Ridge Zone to further test the extent of the mineralization to the south south-east (SSE).   • Appia holds a total of 75,314 hectares (186,106 acres) of land on four uranium claim blocks in the prolific Athabasca Basin (Loranger, North Wollaston, Eastside and Otherside). Exploration plans for these properties are expected to be announced once permits are in hand.
  • Appia also has a 100% interest in 12,545 hectares (31,000 acres), with rare earth element and uranium deposits over five mineralized zones, in the Elliot Lake Camp, Ontario.

The updated MRE also showed a significant initial underground resource of 1.1M ounces of gold in the Inferred category grading 3.12 g/t Au with mineralization remaining open at depth below the limits of the defined resources in Block 4 at more than 1,000 meters depth. The company noted that the updated MRE will be used in its upcoming Preliminary Economic Assessment ("PEA"), which is expected to be released sometime during Q2 2024.

In early 2021, the Company announced an exciting new greenfield gold discovery at its Oko West project in Guyana, where, after 22 months of resource definition drilling, the Company has announced an initial Mineral Resource Estimate (MRE) containing 2.475 Moz of gold in Indicated resources at 1.84 g/t and 1.762 Moz of gold in inferred resources at 2.02 g/t contained within a pit shell outline. Oko West Project

Reunion Gold’s Oko West Project is a brand-new gold discovery in northwest Guyana located within the historical Oko gold district. Alluvial gold has been mined from the Oko district since the turn of the century, but very little primary gold has been mined or even explored for to the best of the company’s knowledge. The project comprises a prospecting license with an area of approximately 44 square kilometers and is 100% held by Reunion’s Guyanese subsidiary.

In 2020, Reunion Gold’s geochemical survey, trenching and initial 1000 m drill program discovered and confirmed the presence of gold mineralization in this Orogenic gold system. The gold occurs in the eastern edge of the project area, along a 6km long sheared contact between a granitoid intrusion and a meta volcanic-meta sedimentary rock package. The MRE is located within the Kairuni zone, which represents the northern most 1.9 km of the 6 km long contact.

“We are advancing our Oko West project along two tracks. The first is to advance the exploration programs outside of the Kairuni zone, aimed at outlining and discovering additional gold mineralization within our Prospecting License. On this front, I am very excited by the results from the initial Scout RC Geochem drill program that is defining new targets west of our Kairuni zone,” Rick Howes, President and CEO of Reunion Gold, stated in a recent news release. In addition to the targets west of the Kairuni zone, the company has also commenced exploration work on the southern ~ 4 km of the same sheared contact that hosts the Kairuni zone MRE. In addition, the company feels that the MRE marks the size of the Kairuni resource at a point in time and that there is good potential to continue to grow the resource. The MRE remains open at depth below the resource pit outline in the block 4 area and also to depth and along strike in the block 5 and 6 areas. In addition to the exploration programs, the second strategic track is to rapidly advance the Kairuni zone along the path to development. To that end the company is moving forward with the engineering and other studies, including more detailed metallurgical studies, that will support the release a PEA on the Kairuni zone by year end 2023 The company feels that the rapid advancement of development of Kairuni zone MRE, while in parallel continuing to explore for additional ounces on the project, is the best path to try and maximize shareholder value in the shortest period of time.

Guyana

Guyana boasts a long history of mining gold, bauxite, diamonds and manganese. Still, the greenstone belts of the Guiana Shield remain relatively unexplored when compared to the analogous regions of the West African Shield (Birimian), which, according to geological evidence, was once connected to the Guiana Shield, forming a contiguous craton prior to the Mesozoic period.

Despite a historical lack of accessibility and low exploration intensity, several significant large-scale projects have emerged in the Guiana Shield, including Aurora, Oko West, Oko Main, Toroparu and Omai. Guyana is English speaking with a British based parliamentary and legal system and boasts the world’s fastest growing economy on the back of significant offshore oil discoveries by Exxon and its partners. It is expected that a significant amount of the revenues from oil production will be invested in improving the infrastructure, education and health care and agriculture within the country.

The property is wholly controlled by the title holder, Empresa Minera Villegas S.R.L. It is located 48 kilometers north of Tupiza city, in the Sud Chichas Province of the Department of Potosi. This is an important mineral deposit type in the prolific South Mineral Belt of Bolivia. Eloro commissioned a NI 43-101 Technical Report on Iska Iska, which was completed by Micon International Limited and is available on Eloro’s website and under its filings on SEDAR.

A fully financed drill program is currently underway on the property, situated near world-class deposits including Silver Sand, San Bartolomé, Pulacayo, San Cristobal, San Vicente, Chorolque, Tasna, Choroma and Siete Suyos. Iska Iska is in the southwest part of the Eastern Cordillera, which hosts a number of major polymetallic mines and mineral deposits. Drilling and continuous channel sampling results have demonstrated some very high metal values, especially silver and tin, within an immense system, where mineralization has been encountered in every drill hole to date. The company believes there is excellent potential for world-class bulk mineable deposits.

La Victoria – Ancash, Peru

Located in Ancash Department, La Victoria sits on the western slopes of the Peruvian Andes. The property is located 12 hours from Lima, with a travel distance of 600 kilometers. The nearest road accessible population centers from La Victoria are Huandoval, Pallasca and Cabana. The project includes four principal mineralized zones in Peru’s prolific North-Central Mineral Belt – San Markito, Victoria, Victoria South and Ccori Orcco – with excellent potential for gold discovery. Market Outlook

According to industry association The Silver Institute, the outlook for silver demand is exceptionally promising, with global demand forecast to rise to a record high of 1.112 billion ounces in 2022. The increase will be driven by record silver industrial fabrication, which is forecast to improve by 5%, as silver’s use expands primarily in solar energy and electric vehicle (EV) manufacturing. The institute states that government commitments to carbon neutrality have resulted in a rapid expansion of green energy projects, driving record photovoltaic panel installations which are expected to lift silver demand in this segment to an all-time high in 2022.

Rising demand in the electronics industry is also boosting the demand for tin, which is primarily used in solder. The electronics and electrical industries use solders containing 40-70% tin, which provide strong and reliable joints under a variety of environmental conditions. At present, the majority of the assemblers are using patented tin-and-copper-based solders. Mordor Intelligence estimated tin demand at 387 kilotons in 2021 and forecasts demand growth of 2.5% annually through 2027. Market Opportunity

Mountain Top Capital Fund I has a target to raise $75 million to acquire, renovate and remarket Hamptons waterfront or water view properties. The fund has secured debt capital commitments for 70% of the acquisition costs and 100% of the construction costs and will use $10 million to leverage strategic waterfront opportunities in and around the Hamptons.

Profits from each project will be distributed upon the sale of the project, which is anticipated every 15 to 18 months, with a target of a minimum return on investment of 20% to 30% per transaction.
