Last week, a federal appeals court ruled against the U.S. Drug Enforcement Agency (DEA) in a lawsuit filed by a doctor in Washington state who sought to get psilocybin rescheduled. The U.S. Court of Appeals for the Ninth Circuit stated that the agency hadn’t explained its reasoning when it denied Dr. Sunil Aggarwal’s petition, and the court ordered the DEA to provide a more complete justification.

In its letter of denial, the DEA stated that a precondition to transferring a substance from Schedule I to II under the Controlled Substance Act was for the U.S. Food and Drug Administration (FDA) to conclude that said substance had a currently accepted medical use in the United States. The agency further noted that the FDA has yet to communicate any accepted medical use for psilocybin in treatment and added that the Controlled Substances Act required that psilocybin remain in Schedule I.

For a couple of years now, Aggarwal had been seeking ways to legally access psilocybin to administer to terminally ill cancer patients who were undergoing end-of-life care. He initially sought to acquire permission from regulators under federal and state right-to-try laws, which allow patients with terminal illnesses to try investigational drugs that hadn’t been approved for general use.  When the Drug Enforcement Administration turned down the request, Aggarwal filed a lawsuit against the agency.

Early last year, a federal appellate panel dismissed the lawsuit, declaring that the court had no jurisdiction as the DEA’s rejection did not constitute a reviewable agency action. This led Aggarwal to file a formal rescheduling petition. The Ninth Circuit court’s ruling was issued as an unpublished opinion, which means it doesn’t establish legal precedent beyond the current case.

The court’s ruling also failed to honor a request by the doctor’s lawyers to send the petition to the FDA for review, as the Department of Health and Human Services agency would have been better suited to evaluate the accepted medical use of psilocybin.

It should be noted that while the ruling doesn’t change psilocybin’s current legal status, it does keep alive the petition to reschedule said drug.

This comes as more research strengthens psilocybin’s case for legitimate medical use. For instance, in September, researchers at the Ohio State University and Johns Hopkins universities published a report that linked the use of psilocybin to persisting reductions in anxiety, depression and alcohol misuse, as well as increases in extraversion, spiritual well-being and emotional regulation.

A separate study by the American Medical Association also determined that individuals with major depression saw clinically significant sustained reductions in their symptoms following the administration of a single dose of psilocybin.

The steps that individuals such as Aggarwal are taking to ensure that policies are reformed to allow the use of psychedelics for therapeutic purposes are a good complement to the data coming out from companies such as Seelos Therapeutics Inc. Japanese automakers are poised to debut a variety of electric vehicle models at an upcoming auto show in a bid to catch up to EV industry leaders Tesla and BYD. Mazda Motor is poised to show off a sportscar concept of a plug-in electric car equipped with the company’s signature rotary engine while Honda Motor will debut its concept for the Prelude sportscar EV. Top vehicle brand Toyota Motor also has a battery-powered Lexus concept that is set to hit the market in 2026.

American and Chinese companies have dominated the global electric vehicle industry so far. Tesla struck while the market was still young and secured a monopoly, but the Texas-based automaker has been forced to contend with increased competition locally and abroad. In the United States, established companies such as Ford and General Motors as well as startups such as Lucid have been giving Tesla a run for its money.

Over in China, local automakers such as BYD have pressured Tesla so much that the company was forced to make several price cuts to remain competitive. Japan, on the other hand, hasn’t made a large impact on the nascent electric vehicle market even though the nation has a massive automotive industry. Electric vehicles account for less than 5% of Japan’s auto market compared to the U.S. where EVs make up a little under 10% of vehicle sales.

Toyota executives admit the company has been slow to adopt electrification, partly due to its past success with hybrid cars such as the Prius, which sold 15 million units worldwide by 2021. Aside from the bZ4X and a small two-seater Toyota developed with Subaru, Toyota’s first electric vehicle offering will be the Lexus LF-ZC. Kato said the company is looking forward to building an “electrified future” with its customers.

Pressure from conservative factions eventually caused the bill to be passed out of committee unanimously.

According to Justin Strekal, the National Organization for the Reform of Marijuana Laws (NORML) former director in charge of political affairs and founder of a procannabis legalization PAC, cannabis reform has reached the “fight you” stage. With drug reformists in the nation scoring major wins in recent years, Strekal said the recent losses to anti-legalization factions showed that things can go wrong at the last moment.

More than a dozen lawmakers led by Lankford and Representative Pete Sessions also sent a letter to the U.S. Drug Enforcement Administration asking it to reject a proposal to reduce federal cannabis restrictions by the Biden administration. This came after President Joe Biden directed the U.S. Department of Health and Human Services to recommend a review of marijuana’s status under the Controlled Substances Act.

The lawmakers argued that cannabis rescheduling decisions should be based on science and proven facts rather than popular opinion or legislative changes at the state level.

Senators Cynthia Lummis and Steve Daines were also quick to respond and introduced a bill that would require Congressional approval before the Biden administration could make any changes to federal cannabis policy.

Jon Hunt, Ph.D., has over 35 years’ experience in the medical/medical device industry with extensive domestic and international experience in general management, clinical/regulatory, sales and marketing. Projects

PCH Project-Brazil

The PCH project hosts REE mineralization in both ionic clays developed from the weathering of alkaline granites and in-situ rare earth mineralization associated with the underlying granite and a carbonatite intrusion to depths greater than 100 meters. Sampling data shows enrichment in rare earth minerals to depths of between eight meters and +30 meters.

In early 2023, Appia announced a definitive agreement to acquire a 70% interest in the PCH Project, which is 17,551 hectares in size and located in the Tocantins Structural Province of the Brasília Fold Belt, Goiás State, Brazil. It is classified as an alkaline intrusive rock occurrence with the potential for highly anomalous REE and Niobium mineralization.

The region around Iporá, a city located roughly 30 km from the PCH Project, has significant mineral exploration and mining activity and well-developed infrastructure.

In July 2023, Appia commenced an aggressive auger and reverse circulation (RC) drill campaign to delineate a potential resource estimate at the PCH project. Initial results at the site revealed significant exploration potential with impressive values that often surpass known ionic clay deposits in Brazil, particularly for the highly valuable heavy rare earths Terbium and Dysprosium.

The auger holes drilled at Target 4 have exhibited a range of total REE grades, ranging from 274 ppm to 16,648 ppm (1.66%), with an average of 1,291 ppm total REE. The valuable rare earths used in magnet applications – praseodymium, neodymium, terbium and dysprosium (Pr, Nd, Tb, and Dy) plus yttrium (Y) accounted for approximately 14% of total rare earths, reaching a maximum of 28.4%. Notably, the deposit also contains anomalous values of niobium and scandium, with average values of 736 ppm for Nb and 62 ppm for scandium in a composite sample from Target 4.

Heavy rare earths (HREEs) show maximum values of 1,624 ppm and average values of 1,291 ppm, primarily as terbium and dysprosium. Light rare earths (LREEs) show maximum values of 14,024 ppm (1.54%) with an average of 1,145 ppm. Neodymium and praseodymium, the main magnetic light rare earths, show respective maximum values of 3,131 ppm (Nd) and 885 ppm (Pr) and average values of 216 ppm (Nd) and 61.7 ppm (Pr). The overall HRRE/LREE ratio has a maximum of 39.5% and an average value of 16.67%.

Alces Lake Project – Saskatchewan

Appia’s Alces Lake project, located in northern Saskatchewan, encompasses some of the highest-grade total and critical REEs and gallium mineralization in the world, hosted within several surface and near-surface monazite occurrences that remain open at depth and along strike.

Following the company’s acquisition of additional new mineral claims in the area in February 2023, Appia’s Alces Lake claim block now totals 38,522 contiguous hectares (95,191 acres) – 100% owned by the Company.

Appia announced the completion of a NI43-101 technical report on the property in June 2023, providing an update on exploration previously reported in March 2021.The report is available on SEDAR under the company’s profile.

Extensive diamond drilling and geophysics surveys are underway to explore a more than 25-kilometer structural corridor. In July 2023, the company issued an update on its diamond drill program having completed the first phase of drilling at the project’s Magnet Ridge Zone to further test the extent of the mineralization to the south south-east (SSE). President Stephen Burega noted the presence of “continued mineralization at significantly thicker intercepts.”

Appia will also undertake reconnaissance drilling on priority regional geological and geophysical targets in the Western Anomaly area.

Other Projects

  • Appia holds a total of 75,314 hectares (186,106 acres) of land on four uranium claim blocks in the prolific Athabasca Basin (Loranger, North Wollaston, Eastside and Otherside). Exploration plans for these properties are expected to be announced once permits are in hand.
  • Appia also has a 100% interest in 12,545 hectares (31,000 acres), with rare earth element and uranium deposits over five mineralized zones, in the Elliot Lake Camp, Ontario.

The Tin Domain Type metallurgical testwork will focus on the predominant surface oxide domain only with a view to produce a lead-silver concentrate via the same flowsheet developed for the Polymetallic Domain Type mentioned above. Tin Recovery will not be part of the formal PEA deliverable, but its recovery will be tracked for future reference and use.

Core will be crushed and sized into -60mm+25mm, -25mm+9.5mm and -9.5mm+0.85mm by WAI the +9.5mm products will be shipped to TOMRA in Germany for cascade "XRT ore-sorting" tests, whilst the -9.5mm+0.85mm will be tested using heavy liquids to further identify the amenability of the ore to Dense Media Separation ("DMS") with further PEA metallurgical tests to be completed on the -0.85mm material and pre-concentrated products from the aforementioned test work.

Definition drill program in progress will focus on expanding the higher-grade Polymetallic Domain mineral resource, which as previously reported contains an inferred mineral resource of 132 million tonnes at 24.3 g Ag/t, 1.11% Zn and 0.50% Pb at an NSR cutoff of $US25/t for a net NSR value of US$34.40 based on a cutoff grade of US$9.20/t.

This higher-grade resource is included within the much larger inferred mineral resource in the Polymetallic Domain Type (Ag-Zn-Pb) of 541 million tonnes grading 13.6 g Ag/t, 0.69% Zn and0.28% Pb with an NSR value of US$20.32/t at an NSR cut-off of US$9.20/t. The Tin Polymetallic Domain Type (Sn-Pb-Ag) which has an inferred mineral resource of 110 million tonnes grading 0.12% Sn, 0.14% Pb and 14.2 g Ag/t with an NSR value of US$12.22/t at an NSR cut-off of US$6.00/t is very under drilled and is a major exploration target going forward.

Iska Iska – Potosi, Bolivia

Iska Iska is associated with a Miocene possibly collapsed/resurgent caldera, emplaced on Ordovician age rocks with major breccia pipes, dacitic domes and hydrothermal breccias. The property is wholly controlled by the title holder, Empresa Minera Villegas S.R.L. It is located 48 kilometers north of Tupiza city, in the Sud Chichas Province of the Department of Potosi. This is an important mineral deposit type in the prolific South Mineral Belt of Bolivia. Eloro commissioned a NI 43-101 Technical Report on Iska Iska, which was completed by Micon International Limited and is available on Eloro’s website and under its filings on SEDAR.

A fully financed drill program is currently underway on the property, situated near world-class deposits including Silver Sand, San Bartolomé, Pulacayo, San Cristobal, San Vicente, Chorolque, Tasna, Choroma and Siete Suyos. Iska Iska is in the southwest part of the Eastern Cordillera, which hosts a number of major polymetallic mines and mineral deposits. Drilling and continuous channel sampling results have demonstrated some very high metal values, especially silver and tin, within an immense system, where mineralization has been encountered in every drill hole to date. The company believes there is excellent potential for world-class bulk mineable deposits.

La Victoria – Ancash, Peru

The La Victoria project, targeting gold and silver production, is situated near world-class, low-cost gold producers Pan American Silver and Barrick Gold Corporation. Located in Ancash Department, La Victoria sits on the western slopes of the Peruvian Andes. The property is located 12 hours from Lima, with a travel distance of 600 kilometers. The nearest road accessible population centers from La Victoria are Huandoval, Pallasca and Cabana. The project includes four principal mineralized zones in Peru’s prolific North-Central Mineral Belt – San Markito, Victoria, Victoria South and Ccori Orcco – with excellent potential for gold discovery. Operations at La Victoria are planned to proceed with a 2,000-meter diamond drilling program to test targets to outline potential resources at San Markito. Trenching and sampling confirmed high silver values and veins at San Markito in 2020.

Market Outlook

According to industry association The Silver Institute, the outlook for silver demand is exceptionally promising, with global demand forecast to rise to a record high of 1.112 billion ounces in 2022. The increase will be driven by record silver industrial fabrication, which is forecast to improve by 5%, as silver’s use expands primarily in solar energy and electric vehicle (EV) manufacturing. The institute states that government commitments to carbon neutrality have resulted in a rapid expansion of green energy projects, driving record photovoltaic panel installations which are expected to lift silver demand in this segment to an all-time high in 2022.

Rising demand in the electronics industry is also boosting the demand for tin, which is primarily used in solder. The electronics and electrical industries use solders containing 40-70% tin, which provide strong and reliable joints under a variety of environmental conditions. At present, the majority of the assemblers are using patented tin-and-copper-based solders. Mordor Intelligence estimated tin demand at 387 kilotons in 2021 and forecasts demand growth of 2.5% annually through 2027. Over the medium term, surging demand from the EV market and increasing applications in the electrical and electronics industry is expected to drive the market.
